Criminal Check Booking Terms & Conditions

1. Who we are

2. What the Service is — and is not

2.1 We perform an in-person criminal background check and/or ID verification at the office, date and time shown in your booking confirmation. 2.2 Our criminal checks are private screening / AFIS-type checks — they are not a SAPS Police Clearance Certificate, unless we expressly state otherwise. If you need an official SAPS clearance (for emigration, a visa, or a foreign employer), this is not that service; please confirm what your recipient requires before booking. 2.3 Turnaround times depend in part on third-party screening providers and government systems, and are estimates rather than guarantees.

3. Bookings and payment

3.1 Appointments run in the slots shown at the time of booking, subject to availability. 3.2 Your booking is confirmed only once payment has been received and we have emailed you a booking reference; selecting a slot does not reserve it. 3.3 Prices are shown before you pay, in South African Rand, inclusive of VAT where applicable. Payment is processed by Yoco; we do not receive or store your card details. 3.4 You must give accurate details, including full names exactly as they appear on the identity document that will be presented.

4. What to bring

4.1 Please arrive 10 minutes before your appointment time. 4.2 Bring the original South African ID — green barcoded ID book or smart ID card. Copies, photographs and digital images are not accepted.

5. Changing your appointment (rescheduling)

5.1 If you cannot make your appointment, change it — do not cancel it. You may move your booking to another available date and time free of charge, as often as you need, through the online Manage Booking page, provided more than 24 hours remain before your appointment start time (South African Standard Time). 5.2 At 24 hours or less before your appointment, online rescheduling is disabled and the system will not process a change; your appointment then stands as booked. 5.3 A changed appointment keeps its original booking reference and remains subject to these Terms.

6. Cancellations, no-shows, refunds and cancellation charges

6.1 Rescheduling and cancelling are different. Clause 5 lets you change your appointment free of charge up to the 24-hour cutoff — usually the best option if your plans change. 6.2 Cancellation by you: you may cancel at any time. Where South African law permits, we may retain the maximum reasonable cancellation charge allowed under applicable South African law, under section 17 of the Consumer Protection Act 68 of 2008 (“CPA”), assessed in light of the circumstances — including the section 17(5) factors (the nature of the Service, the notice you gave, our reasonable ability to re-fill the slot, and ordinary industry practice) and the fact that you could reschedule free of charge before the cutoff. This is a reasonable charge, not a penalty, and it does not apply automatically in full in every case. 6.3 A “no-show” — not attending, arriving without the required original ID, or arriving too late for the Service to be performed in the remaining slot time — is treated as a late same-day cancellation, and clause 6.2 applies. 6.4 Where you are entitled to a refund: (a) in accordance with CPA section 17(4), where cancellation is due to the death or hospitalisation of the person the check was booked for (reasonable proof may be requested) — no cancellation charge applies; (b) where section 44 of ECTA applies and you cancel in writing within 7 days of making the booking (subject to the exceptions in that Act); and (c) where we cancel or cannot perform the Service (clause 7). 6.5 Any refund due is paid to your original payment method within 10 business days of approval. 6.6 Nothing in this clause removes or limits any mandatory refund or right that South African law gives you.

7. If we cancel

If we cancel your appointment, or cannot perform the Service to the standard required by section 54 of the CPA, you may choose either a re-booking at no extra charge or a full refund. We will tell you as soon as reasonably possible if we need to cancel or move an appointment.

8. Privacy and personal information (POPIA)

8.1 We process personal information to take, confirm and deliver your booking and to perform the Service, in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”). 8.2 A criminal check involves special personal information — information about criminal behaviour, and biometric information in the form of fingerprints. By booking, you consent to us and our accredited screening providers processing the information reasonably necessary for that purpose. 8.3 If you are booking for someone else, you confirm that person knows about and has consented to the check, that you are entitled to receive the results, and that they will attend in person with their own original ID (and may be asked to sign a consent form). If they decline, we cannot perform the Service and clause 6 applies. 8.4 Consent may be withdrawn before the Service is performed; if withdrawn, we cannot perform the Service and clause 6 applies. 8.5 We keep personal information only as long as necessary or as the law requires, and share it only with the providers and authorities involved in delivering the Service. 9. Complaints

Please raise any concern with us first on 082 765 0908 / 021 801 4862 or admin@jbasecurity.co.za. If we cannot resolve it, you may refer the matter to the National Consumer Commission, to PSIRA, or to the Information Regulator (for personal-information complaints). Nothing in these Terms prevents you from exercising your legal rights or lodging a lawful complaint or claim.

10. Your statutory rights

These Terms are subject to the CPA, ECTA, POPIA and other applicable South African law. Nothing in them removes, waives or limits any right you have under that law that cannot lawfully be excluded; where a provision conflicts with such a right, your statutory right prevails. We do not exclude any liability the law does not permit us to exclude, including under section 61 of the CPA.

11. General

11.1 These Terms are governed by South African law. 11.2 If any provision is found unenforceable, the rest continues to apply. 11.3 These Terms are versioned: the version in force when you booked governs your booking, and we store the version and the timestamp you accepted — later changes do not alter the terms already accepted for an existing booking.
